TERMS OF SERVICE

Secret Room Gdańsk — Restaurant, Cocktail Bar, and Lounge

§ 1. General Provisions

  1. These Terms of Service (hereinafter the "Terms") set out the rules for using the services provided by the Service Provider, both at the Secret Room venue in Gdańsk and electronically through the website secretroomgdansk.pl and the tools associated with it (the reservation system, forms, electronic vouchers, and the loyalty program).

  2. The Service Provider is Eldar Kurseitov, operating as a sole proprietorship, Tax ID (NIP): 5842794144, Business Registry Number (REGON): 386285549.

  3. Registered business address (as recorded in the CEIDG business registry): al. Grunwaldzka 69, 80-241 Gdańsk.

  4. Venue address: Stępkarska 7, 80-859 Gdańsk.

  6. These Terms have been issued in fulfillment of the obligation referred to in Article 8 of the Act of July 18, 2002 on the Provision of Electronic Services, and in accordance with the provisions of the Civil Code, the Act of May 30, 2014 on Consumer Rights, and other generally applicable laws.

  7. These Terms are made available free of charge on the website secretroomgdansk.pl in a manner that allows them to be obtained, reproduced, recorded, and printed.

  8. Acceptance of these Terms is voluntary but necessary to enter into a contract for the provision of services, including, in particular, to make an online reservation.

§ 2. Definitions

The terms used in these Terms have the following meanings:

  • Service Provider / Venue — Eldar Kurseitov, conducting business under the name "Secret Room" at the venue located at Stępkarska 7 in Gdańsk.

  • Customer / Guest — any person using the services provided by the Service Provider, whether at the venue or electronically.

  • Consumer — a natural person entering into a legal transaction with the Service Provider that is not directly related to that person's business or professional activity, within the meaning of Article 22¹ of the Civil Code.

  • Privileged Entrepreneur — a natural person conducting business activity who enters into a contract directly related to that business activity, but where the contract is not of a professional nature for that person.

  • Website — the website secretroomgdansk.pl, together with its subpages and associated tools.

  • Reservation — a reservation of a table or area at the venue for a specified date and time, placed by the Customer and confirmed by the Service Provider.

  • Pre-order — an order for specific menu items placed in advance of the Customer's visit to the venue.

  • Voucher — a gift certificate entitling the holder to pay for the services and products offered at the Secret Room venue.

  • Loyalty Program — the "Secret Community" program operated by the Service Provider through the Apple Wallet and Google Pay applications.

  • Shisha Area — a designated smoking room at the venue where water pipe (shisha) services are provided.

  • VIP Room — a separate, private area of the venue that may be reserved individually.

  • Terms — these Terms of Service.

§ 3. Scope of Services

  1. The Service Provider provides the following services at the venue:
  • food services (European, signature, and seasonal cuisine);
  • bar services (signature cocktails, alcoholic and non-alcoholic beverages);
  • water pipe (shisha) smoking services in a designated area of the venue;
  • event-hosting services (birthdays, corporate events, rental of areas or the entire venue).

  1. The Service Provider provides the following services electronically:
  • enabling online table reservations;
  • enabling the purchase of a gift voucher (physical or electronic);
  • operating the Secret Community loyalty program;
  • sending a newsletter (subject to separate consent);
  • enabling contact through the contact form and the event-hosting inquiry form.

  1. The venue does not provide its own delivery service. Delivery orders are fulfilled exclusively through the third-party services Glovo and Uber Eats, under the conditions set by those services.

§ 4. Venue Opening Hours

  1. The venue is open during the following hours:
  • Monday – Thursday: 5:00 PM – 12:00 AM (midnight);
  • Friday: 5:00 PM – 1:00 AM;
  • Saturday: 3:00 PM – 1:00 AM;
  • Sunday: 3:00 PM – 12:00 AM (midnight).

  1. The kitchen is open during the following hours:
  • Sunday: 3:00 PM – 10:00 PM;
  • Monday – Thursday: 5:00 PM – 10:00 PM;
  • Friday: 5:00 PM – 11:00 PM;
  • Saturday: 3:00 PM – 11:00 PM.

  1. The venue accepts orders from the kitchen menu only until the kitchen closing time specified in paragraph 2 (10:00 PM or 11:00 PM, as applicable). After that time, orders may be placed only from the drinks menu and for the water pipe (shisha), subject to § 15 paragraph 12.

  2. The cutoff time for the last water pipe (shisha) order depends on how busy the venue is and the format of the evening. To find out the last-order time on a given day, the Customer is asked to call +48 888 773 999.

  3. Opening hours during holiday periods (including Christmas, New Year's Eve, New Year's Day, and Easter) may change. Current information is published on the website and on the venue's social media.

§ 5. Table Reservations

  1. A Customer may reserve a table in one of the following ways:
  • through the online form available on the website secretroomgdansk.pl;
  • through Google Maps;
  • by telephone at +48 888 773 999, during the venue's opening hours.

  1. To make a reservation, the following information is required: first name, telephone number, email address, the date and time of the reservation, and the number of guests.

  2. A reservation is confirmed by the Service Provider via email or by telephone. The contract for the provision of the service is concluded upon delivery of the reservation confirmation to the Customer.

  3. If the Customer does not receive a reservation confirmation, the Customer should check the "Spam" folder of their email inbox. If no confirmation is found, the Customer is asked to call to verify the status of the reservation.

  4. The Customer may indicate seating preferences (for example, a table by the window, a sofa, or the lounge area). The Service Provider will make an effort to accommodate these preferences; however, the final seating depends on availability and the layout of the dining room on a given day and is not guaranteed.

  5. The venue's services may also be used without a prior reservation (walk-in); however, the availability of free tables depends on current occupancy. To avoid waiting, making a reservation is recommended.

§ 6. Pre-orders and Advance Payment

  1. The Customer may place a pre-order, i.e., specify particular menu items in advance. This is especially recommended for events, business meetings, or when the Customer wants the food and drinks to be ready upon arrival.

  2. The venue collects an advance payment equal to 20% of the estimated order value in the following cases:
  • a table reservation with a pre-order of food, drinks, or a water pipe (shisha);
  • a table reservation for a group of 10 (ten) or more people on Fridays, Saturdays, and Sundays — regardless of whether a pre-order has been placed.

  1. For the rental of the entire venue for a private event, an advance payment of 100% of the rental cost is required, together with a full pre-order of food and drinks. The detailed rules are governed by § 10.

  2. Other reservations (without a pre-order, for smaller groups, on standard days) do not require an advance payment, subject to the special reservation conditions for the days specified in § 22 and under the special offers referred to in § 21.

  3. The rules for refunding the advance payment and the reservation cancellation policy are governed by § 8.

  4. To place a pre-order, the Customer contacts the venue by any means (by telephone or email). The details of the pre-order (the list of dishes, dates, and payment method) are arranged on an individual basis.

§ 7. Length of Stay, Late Arrival, and Early Arrival

  1. Every reservation is made for a specific time, with an allotted length of stay at the table.

  2. If the Customer arrives before the reservation time, the Service Provider does not guarantee the immediate availability of the table — the table may still be occupied by previous Guests or in the process of being prepared.

  3. If the Customer arrives late, their length of stay at the table may be shortened accordingly so that the venue can seat the next Guests in line with the reservation schedule.

  4. If the Customer does not arrive at the venue at the time specified in the reservation and does not notify the venue of the delay, the Service Provider reserves the right to release the table and offer it to other Guests. The decision to release the table is made on an individual basis by the venue staff, taking into account current occupancy, upcoming reservations, and the circumstances of the particular day.

  5. The Customer is required to notify the venue, with reasonable advance notice, of any late or early arrival. The Service Provider will make an effort to find a solution convenient for the Customer.

§ 8. Cancellation of Reservations and No-Shows

  1. The Customer may cancel a reservation without incurring any costs in the following manner:
  • for a reservation without a pre-order and without a required advance payment — at any time before the planned visit time, while still being obligated to notify the venue;
  • for a reservation with a pre-order or with a required advance payment as referred to in § 6 paragraph 2 — no later than 72 (seventy-two) hours before the planned visit time;
  • for the rental of the entire venue for a private event — no later than 14 (fourteen) days before the planned event date (in accordance with § 10).

  1. To cancel a reservation, the Customer is asked to call +48 888 773 999 or send a message to kontakt@secretroomgdansk.pl, indicating the telephone number used to make the reservation or the name of the person who made it.

  2. If a reservation with a pre-order is canceled after the 72-hour deadline has passed, the advance payment made is non-refundable in cash. The Customer is, however, entitled to choose one of the following options:
  • use the value of the advance payment toward a reservation on another date agreed with the venue;
  • receive a Secret Room voucher for an amount equal to the advance payment made, under the rules set out in § 18.

  1. If the Customer fails to arrive for a reservation without canceling it in advance (a no-show), the advance payment made is forfeited in full. The Customer is not entitled to a refund of the advance payment or to a replacement voucher.

  2. The venue does not charge any additional contractual penalties beyond the loss of the advance payment referred to in paragraphs 3 and 4.

  3. The rules for canceling a reservation for the rental of the entire venue are governed in detail by § 10.

  4. The above provisions constitute liquidated damages covering the actual losses incurred by the venue in connection with reserving the space and preparing for the Customer's visit.

§ 9. VIP Room Reservations

  1. The venue makes separate VIP Room areas available to Customers, which may be reserved individually.

  2. The conditions for reserving a VIP Room depend on the day of the week:
  • Monday through Thursday — reservations may be made without an advance payment;
  • Friday, Saturday, and Sunday — a minimum order amount applies: PLN 500 for a reservation of up to 3 hours, or PLN 1,000 for a reservation of 4 to 6 hours.

  1. The minimum order amount referred to in paragraph 2 constitutes a guarantee of a minimum order placed at the venue. The Customer does not pay this amount in advance — it is settled together with the bill for the order actually placed. If the actual order value is lower than the required minimum, the Customer is obligated to pay the difference.

  2. A VIP Room reservation without a pre-order and without an advance payment may be canceled at any time, while still being obligated to notify the venue. For a VIP Room reservation with a pre-order, the provisions of § 8 apply accordingly.

§ 10. Event Hosting and Venue Rental

  1. The venue offers the option of hosting private and corporate events for groups of up to 80 people.

  2. It is possible to rent a selected area or the entire venue under conditions agreed individually with the Service Provider. To discuss the details, the Customer is asked to call +48 888 773 999 or use the form available on the subpage secretroomgdansk.pl/events.

  3. Renting the entire venue for a private event requires:
  • an advance payment of 100% of the rental cost, which also covers the cost of the food and drinks included in the full pre-order;
  • placing a full pre-order (a complete menu and drinks list) with appropriate advance notice, agreed individually.

  1. The Customer may cancel a reservation for the rental of the entire venue no later than 14 (fourteen) days before the planned event date. In that case, the amount paid is refunded in full to the Customer's bank account.

  2. If the rental of the entire venue is canceled after the 14-day deadline referred to in paragraph 4, or if the Customer fails to arrive, the amount paid is non-refundable.

  3. Every event arrangement is preceded by an individual quote and an agreement on the conditions, which are confirmed in writing (by email) before the reservation is made and the advance payment is paid.

§ 11. Rules of Conduct on the Premises

  1. The Customer is required to observe generally accepted standards of behavior, to show respect for other Guests and venue staff, and to comply with staff instructions related to safety and order.

  2. The following are prohibited at the venue:
  • bringing in and consuming one's own food and drinks (including alcoholic beverages);
  • bringing in and using one's own substances for the water pipe;
  • aggressive or vulgar behavior, or behavior that disturbs order or the comfort of other Guests;
  • moving furniture or décor on one's own, or tampering with the venue's equipment (including sound, lighting, and shisha equipment);
  • bringing unauthorized persons into areas not accessible to Guests.

  1. The Service Provider reserves the right to refuse service or to ask the Customer to leave the venue in the event of a violation of these Terms, of the law, or of the principles of social conduct, or in the event of a threat to the safety of other Guests or staff. This applies in particular to persons who are intoxicated or under the influence of other intoxicating substances.

  2. The Customer bears full financial liability for damage caused to the venue's property as a result of intentional acts or negligence.

  3. Taking photographs and making audiovisual recordings at the venue is permitted only to the extent that it does not interfere with the privacy of other Guests. Publishing the image of other Guests without their consent is not permitted and may constitute a violation of personal data protection laws and of personal rights.

§ 12. Children on the Premises

  1. The venue does not impose a general entry ban on minors who are under the supervision of adults.

  2. The Customer, as the supervising adult, is obligated to familiarize themselves with the venue's operating format before visiting with a child. In particular, the Customer acknowledges that:
  • the venue sells and serves alcoholic beverages;
  • the venue has a water pipe (shisha) smoking area, and as a result, smoke and the smell of tobacco may be present in the dining room;
  • the venue does not have a children's menu, high chairs, changing tables, or a play area.

  1. The area free of water pipe smoke at the venue is the summer terrace, available during the warm season. The venue does not have a separate, year-round, smoke-free room intended for families with children.

  2. The decision to bring a child to the venue rests with the supervising adult and should be made with the above circumstances in mind, in particular with regard to young children or children sensitive to smoke and odors.

  3. The venue does not impose a cutoff time after which entry is limited exclusively to adults. However, venue staff have the right to require any person whose adult status is in doubt to present a document confirming their age, both when purchasing alcoholic beverages and when ordering a water pipe (shisha). Refusal to present such a document results in a refusal to provide the relevant service.

  4. Full responsibility for a child's behavior and safety at the venue rests with the child's legal guardian.

§ 13. Animals on the Premises

  1. Entry to the venue with a dog is permitted.

  2. The animal's owner is obligated to:
  • maintain control of the animal at all times during the stay at the venue (leash, supervision);
  • ensure that the animal does not disturb the comfort of other Guests;
  • repair any damage caused by the animal.

  1. A guide dog for a person with a disability and an assistance dog are always admitted to the venue, regardless of the other provisions of these Terms, in accordance with the Act of August 27, 1997 on Vocational and Social Rehabilitation and Employment of Persons with Disabilities.

§ 14. Sale of Alcoholic Beverages

  1. The Service Provider sells alcoholic beverages intended for consumption on the premises, on the basis of permits issued by the Mayor of the City of Gdańsk:
  • Permit No. II-11/9/C-24 — for the sale of alcoholic beverages containing more than 18% alcohol;
  • Permit No. II-133/121/A-24 — for the sale of alcoholic beverages containing up to 4.5% alcohol, and beer.

  1. The sale and serving of alcoholic beverages are carried out in accordance with the provisions of the Act of October 26, 1982, on Upbringing in Sobriety and Counteracting Alcoholism.

  2. It is strictly prohibited to serve or sell alcoholic beverages:
  • to persons who are under 18 years of age;
  • to persons whose behavior indicates that they are intoxicated;
  • on credit or against collateral.

  1. Venue staff have the right — and, where there is doubt as to a person's adult status, the obligation — to require the Customer to present a document confirming their age. Refusal to present such a document results in a refusal of sale.

  2. Removing open containers of alcoholic beverages from the venue is prohibited.

§ 15. Shisha Area (Water Pipe)

  1. The venue has a designated area for smoking tobacco in the form of a water pipe (shisha) — constituting a separate room established in accordance with Article 5a of the Act of November 9, 1995, on the Protection of Health against the Consequences of Tobacco and Tobacco Products Use.

  2. Only adults (18+) may use the services in the shisha area. Venue staff have the right to require a person to present a document confirming their age; refusal to present such a document results in a refusal to provide the service.

  3. A Customer using a water pipe declares that they are aware of the harmful effects of tobacco smoking and of the potential health consequences of its use, including the risk of: respiratory and circulatory ailments, allergic reactions, dizziness, nausea, elevated blood pressure, and other health consequences characteristic of tobacco smoking.

  4. The following persons, in particular, should refrain from using a water pipe:
  • pregnant and breastfeeding women;
  • persons suffering from respiratory diseases (including asthma and COPD);
  • persons suffering from circulatory diseases (including hypertension and coronary artery disease);
  • persons with an allergy to tobacco or to the ingredients of tobacco mixtures;
  • persons taking medication whose package insert states a contraindication for smoking.

  1. Before ordering a water pipe, the Customer is obligated to inform the staff of any conditions or ailments referred to in paragraph 5 that affect them, and of any circumstances known to them that may affect the safety of using the service (allergies, pregnancy, chronic illnesses, medications being taken). The absence of such information releases the venue from liability for health consequences arising from the use of the water pipe.

  2. The venue is not liable for health consequences arising from the use of a water pipe, except for damage resulting from the venue's willful misconduct or gross negligence, in particular where the equipment is used in accordance with its intended purpose and under the supervision of venue staff.

  3. The use of a water pipe takes place under the supervision of venue staff (the Hookah Chef).

  4. The Customer is strictly prohibited from:
  • handling parts of the water pipe on their own, including the coals, chimneys, and base;
  • bringing in and using their own tobacco mixtures, molasses, herbs, or any other substances;
  • adding alcohol, intoxicants, psychoactive substances, or any other unauthorized substances to the water pipe;
  • sharing the mouthpiece with third parties in a manner that endangers hygiene or health;
  • using a shared mouthpiece if the person has a respiratory infection, cold sores, or other contagious diseases transmitted by droplets or contact;
  • leaving the venue with parts of the water pipe or its accessories.

  1. A Customer using a water pipe is obligated to use the disposable hygienic mouthpieces provided by the venue. The use of a shared mouthpiece within a group is at the Customer's sole responsibility.

  2. The Customer bears liability for damage to equipment resulting from improper use, in particular from a violation of the prohibitions referred to in paragraph 9.

  3. The cutoff time for the last water pipe order depends on current occupancy and the format of the evening. For information, please call +48 888 773 999.

§ 16. Menu, Prices, and Payments

  1. The current menu, including prices, portion weights, calorie counts, and allergen information, is available at the venue and online at secret-room.choiceqr.com.

  2. All prices listed in the menu are gross prices expressed in Polish zloty (PLN) and include VAT.

  3. The availability of individual items may change during the day. To confirm the availability of a specific item, the Customer is asked to contact the venue.

  4. The menu includes several vegetarian options. The venue does not maintain a separate children's menu.

  5. The venue provides information about the presence of substances causing allergies or intolerance reactions in dishes and drinks, in accordance with Regulation (EU) No 1169/2011 of the European Parliament and of the Council of October 25, 2011, on the provision of food information to consumers (Annex II to the Regulation — the list of 14 allergens). Allergen information is available in the menu card, in the online menu (secret-room.choiceqr.com), and, at the Customer's request, is provided by the staff before an order is placed.

  6. The Customer is obligated to inform the staff of any food allergies, intolerances, or other dietary restrictions before placing an order. This information must be provided each time, regardless of previous visits to the venue.

  7. In the case of a serious food allergy (including a life-threatening one), the Customer should consider the risk associated with the possible presence of trace amounts of allergens. The venue will make an effort to minimize the risk of cross-contamination; however, it cannot guarantee the complete absence of allergens in its dishes.

  8. The venue is not liable for health consequences arising from:
  • failure to inform the staff of an allergy, intolerance, or other dietary restriction before placing an order;
  • providing the staff with incomplete or untrue information about allergies or state of health;
  • consumption of a dish containing trace amounts of an allergen resulting from the cross-contamination referred to in paragraph 7.

  1. In the event of an allergic reaction or another sudden health emergency affecting a Customer or another person present at the venue, the venue staff will, at the request of the affected person or a witness, promptly call for medical assistance.

  2. The venue accepts the following forms of payment:
  • cash in Polish zloty (PLN);
  • payment cards: Visa, Mastercard, Maestro, American Express;
  • contactless payment cards;
  • BLIK;
  • mobile payments: Apple Pay, Google Pay;
  • Secret Room gift voucher, under the rules set out in § 18;
  • "Secret Community" loyalty points, under the rules set out in § 19.

  1. For the bills of groups of 3 (three) or more people, the venue automatically adds a service charge of 10% of the order value. Information about the service charge is communicated to the Customer when making an online reservation (through the form at secretroomgdansk.pl/booking) and is available at the venue. The service charge is part of the Customer's bill and is not the same as a voluntary tip for the staff.

§ 17. VAT Invoices

  1. At the Customer's request, the Service Provider will issue a VAT invoice for the services rendered.

  2. An invoice may be issued:
  • after the visit has ended — the Customer informs the staff of their wish to receive an invoice, providing the necessary details (company name / first and last name, Tax ID (NIP), address, email address);
  • in advance, before the advance payment is made — after the invoicing details have been submitted beforehand.

  1. The invoice is sent to the email address provided or issued at the venue.

  2. The deadline for issuing a VAT invoice is governed by the provisions of the Act of March 11, 2004 on Goods and Services Tax (VAT).

§ 18. Gift Vouchers

  1. The Customer may purchase a gift voucher entitling the holder to pay for the services and products offered at the Secret Room venue.

  2. The venue honors two types of vouchers:
  • Secret Room gift vouchers — purchased by the Customer at the venue or through the form at secretroomgdansk.pl/vouchery, intended in particular as a gift for third parties;
  • vouchers issued by the venue or its partners as part of promotional campaigns, marketing campaigns, contests, compensation arrangements, or cooperation with external entities (for example, promotional websites, business partners, or non-governmental organizations).

  1. The Secret Room gift voucher is available in electronic form (sent to an email address) or physical form (for in-person pickup). The order details (denomination, form, and delivery method) are arranged individually with the Customer.

  2. The validity period of a Secret Room gift voucher is 1 (one) year from the date it is issued.

  3. The validity period of vouchers issued by the venue or its partners as part of the campaigns referred to in paragraph 1(b) is indicated each time directly on the voucher. This period may be shorter or longer than the period applicable to Secret Room gift vouchers.

  4. A voucher may be used as a form of payment for food, drinks, and other services offered at the venue, subject to any restrictions stated in the conditions of a specific promotional campaign (applicable to partner vouchers).

  5. The Customer is obligated to inform the staff of their intention to pay with a voucher before placing an order or before receiving the bill.

  6. A voucher, whether a Secret Room gift voucher or one issued by the venue or its partners, is not exchangeable for cash. A refund of the amount paid for a voucher is not possible.
  7. A voucher is a single-use document. In cases where:
  • the order value is lower than the value of the voucher — the difference is not refunded in cash and does not remain on the voucher for further use;
  • the order value is higher than the value of the voucher — the Customer pays the difference using an available form of payment.

  1. A voucher cannot be combined with other promotions, special offers, the birthday discount, or loyalty program points. A standing rule applies: one discount cannot be combined with another.

  2. A voucher that is lost, stolen, or damaged in a way that makes the code unreadable cannot be reissued or replaced.

  3. After its validity period expires, a voucher becomes void and cannot be redeemed, nor is the amount paid refundable.

  4. The purchase of a Secret Room gift voucher is confirmed by an invoice or a receipt (at the Customer's request).

§ 19. Loyalty Program "Secret Community"

  1. The Service Provider operates a loyalty program named "Secret Community," the purpose of which is to reward the venue's regular Customers.

  2. Joining the Program is voluntary and free of charge. The loyalty card is installed by the Customer themselves through the page secretroomgdansk.pl/loyalty and added to the Apple Wallet or Google Pay application — without the need to install any additional apps.

  3. Points are accrued on the full value of the Customer's bill and cover all sales items at the venue (food, non-alcoholic and alcoholic beverages, and water pipe).

  4. How points are used: points are redeemed for discounts, rewards, and benefits available in the loyalty program app. The current redemption rules are available in the app and on the page secretroomgdansk.pl/loyalty.

  5. The validity period of points is 180 (one hundred and eighty) days from the date they are accrued. Points not used within this period expire.

  6. Loyalty program points cannot be combined with other promotions, discounts, or special offers in effect at the venue. A standing rule applies: one discount cannot be combined with another.

  7. Points accrued under the Program cannot be exchanged for cash.

  8. The Customer may withdraw from the Program at any time by contacting the venue. In that case, the accumulated points expire.

  9. The Service Provider reserves the right to amend the Program's rules, with effect for the future, with appropriate advance notice to Participants — no shorter than 14 days before the changes take effect. An amendment to the rules may not infringe upon Participants' acquired rights.

§ 20. Birthday Discount

  1. A Customer celebrating their birthday may take advantage of a birthday discount of 20% on the entire menu.

  2. Conditions for using the discount:
  • entering the code URODZINY20 in the comments field when making an online reservation through the form at secretroomgdansk.pl/events;
  • holding an active Secret Community loyalty program card;
  • using the discount within 10 days of the Customer's birthday.

  1. The birthday discount covers the entirety of the Customer's order — both food and drinks (including alcoholic beverages) and the water pipe.

  2. Using the birthday discount is not subject to a minimum order value.

  3. The number of people covered by the discount is not limited — the entire group celebrating with the birthday Customer benefits from the preferential price.

  4. The birthday discount cannot be combined with other promotions, special offers, vouchers, or loyalty program points, unless the venue states otherwise.

  5. The Service Provider may require the presentation of a document confirming the date of birth.

§ 21. Special Offers and Promotions

  1. The venue regularly organizes special offers and promotional campaigns, available at secretroomgdansk.pl/events. The offers fall into two categories:
  • regular offers (daily, seasonal), including "Unlimited Steaks," "Unlimited Oysters," "Mediterranean Vacation," and others;
  • occasion-specific offers organized on special days, as referred to in § 22 (including Valentine's Day, New Year's Eve, and holiday menus).

  1. Each special offer has its own detailed conditions, which include in particular:
  • the price per person;
  • the period during which the offer is valid;
  • the maximum length of stay at the table;
  • conditions regarding the number of people at the table covered by the offer;
  • any surcharges for uneaten portions (in accordance with the "we don't waste food" principle);
  • the requirement for an advance reservation;
  • the required amount of the advance payment;
  • the range of drinks covered by the offer;
  • the reservation cancellation policy applicable to the given offer.

  1. The current conditions of an offer are communicated to the Customer before the reservation is made and are published on the subpage secretroomgdansk.pl/events.

  2. Special offers (both regular and occasion-specific) cannot be combined with one another or with other promotions, vouchers, the birthday discount, or loyalty program rewards, unless the rules of a given offer state otherwise.

  3. By making a reservation under a special offer, the Customer accepts the conditions of that offer in effect on the day of the visit.

§ 22. Special-Occasion Events and Special Days

  1. On certain days of the year, in particular days of a holiday or special-occasion character (including New Year's Eve, New Year's Day, Valentine's Day, International Women's Day, Easter, Christmas, Halloween, and long weekends), the venue organizes dedicated occasion-specific offers, which constitute special offers within the meaning of § 21 paragraph 1. Current offers are published at secretroomgdansk.pl/events.

  2. As part of an occasion-specific offer, the venue may in particular:
  • introduce a separate, occasion-specific menu (for example, a Valentine's Day menu, a New Year's Eve menu, or a holiday menu) — in which case the standard menu, or part of it, may be unavailable;
  • set prices in effect only on the given day, different from the prices in the standard menu;
  • introduce a requirement for all Guests at the table to order the occasion-specific menu (a set menu), with a specified price per person;
  • require an advance payment (deposit) in a specified amount, regardless of the general reservation rules described in § 6 and § 9;
  • limit reservations to specific hours or formats only (for example, two evening seatings);
  • specify a maximum and minimum length of stay at the table;
  • introduce a requirement to make a reservation in advance, excluding same-day (walk-in) reservations.

  1. On days when an occasion-specific offer is in effect, the following do not apply:
  • the regular (daily) special offers referred to in § 21 paragraph 1, including "Unlimited Steaks," "Unlimited Oysters," and "Mediterranean Vacation";
  • the birthday discount referred to in § 20;
  • the benefits and rewards of the "Secret Community" loyalty program, unless the venue states otherwise;
  • other promotions and discount coupons — with the reservation that payment by gift voucher remains possible, unless the rules of the given occasion-specific offer state otherwise.

  1. The detailed conditions of each occasion-specific offer, including the menu price, the amount of the advance payment, reservation deadlines, and the cancellation policy, are published with appropriate advance notice on the website secretroomgdansk.pl/events and on the venue's social media, and are communicated to the Customer when the reservation is made.

  2. The reservation cancellation policy for an occasion-specific offer may be more stringent than on standard days — in particular, the advance payment made may be subject to special refund rules, clearly defined in the conditions of the given offer. The Customer accepts these conditions at the time the reservation is made.

  3. A reservation made under an occasion-specific offer in accordance with the conditions published by the venue constitutes the Customer's acceptance of those conditions.

§ 23. Guest Wi-Fi

  1. The venue provides Guests with free Wi-Fi.

  2. By using the Wi-Fi, the Customer undertakes not to use the network for activities that are unlawful or contrary to good practice. The Service Provider is not liable for how the Customer uses the network.

§ 24. Items Left on the Premises

  1. If personal items are left at the venue, the Customer may report this by telephone at +48 888 773 999 during the venue's opening hours.

  2. The venue will check the information and take action to help the Customer recover the items.

  3. The venue is not liable for items left unattended by the Customer, in particular for money, documents, telephones, and other valuable items.

  4. Items found at the venue are kept for the period necessary to attempt to contact the owner or to hand them over to the appropriate authority, in accordance with the provisions of the Act of February 20, 2015 on Lost Property. The venue will make an effort to contact the owner of the items if the owner's details can be determined.

§ 25. Parking

  1. Both paid and free parking spaces are located in the immediate vicinity of the venue.

  2. The number of parking spaces is limited and depends on current occupancy, and therefore the venue does not guarantee the availability of a parking space at all times.

  3. The venue is not liable for vehicles left in the parking areas near the venue, or for items inside them.

§ 26. Order Delivery

  1. The venue does not operate its own delivery service for ordered food and drinks.

  2. The Customer may order dishes from the Secret Room menu through the third-party delivery services Glovo and Uber Eats. The delivery conditions, including fulfillment hours, the prices of dishes offered in the apps, delivery costs, and the complaints policy, are governed exclusively by those services and do not depend on the Service Provider. An order placed through a third-party service is subject to that service's terms.

§ 27. Complaints

  1. The Customer has the right to file a complaint regarding the services provided.

  2. A complaint may be filed:
  • verbally — directly to the staff at the venue;
  • in writing — to the venue's address: Stępkarska 7, 80-859 Gdańsk;
  • electronically — to the email address: kontakt@secretroomgdansk.pl;
  • by telephone — at +48 888 773 999.

  1. A complaint should include: information identifying the Customer (first name, last name, contact details), the date and time of the incident, a description of the circumstances and subject of the complaint, and the Customer's request.

  2. The Service Provider reviews a complaint promptly, no later than within 14 days of receiving it. A failure to respond within this period is treated as acceptance of the complaint — in accordance with Article 7a of the Act of May 30, 2014 on Consumer Rights.

  3. The response to a complaint is provided in a manner agreed with the Customer (email, letter, or telephone).

§ 28. Right of Withdrawal from the Contract

  1. A Consumer who has entered into a contract with the Service Provider remotely or off-premises has the right to withdraw from the contract within 14 days without giving a reason, under the rules set out in the Act of May 30, 2014 on Consumer Rights.

  2. The right of withdrawal does not apply to the contracts listed in Article 38 of that Act, in particular:
  • contracts for the provision of food services, where the contract specifies a day or period of performance (Article 38(12)) — which applies in particular to a table reservation for a specific day and time;
  • contracts for the supply of digital content not delivered on a tangible medium, for which the Consumer is obligated to pay a price, where the Service Provider has begun performance with the express and prior consent of the Consumer (Article 38(13)) — which may apply to electronic vouchers delivered to and accepted by the Consumer.

  1. In the case of the purchase of a physical voucher that has not been used, the Consumer has the right of withdrawal within 14 days of the date of purchase, under the general rules. The template withdrawal statement is set out in Annex No. 2 to the Act on Consumer Rights.

  2. To exercise the right of withdrawal, the Consumer sends a statement to kontakt@secretroomgdansk.pl or to the Service Provider's registered address.

  3. The provisions concerning the Consumer apply accordingly to natural persons entering into a contract directly related to their business activity, where it is apparent from the content of that contract that it is not of a professional nature for those persons (Article 38a of the Act on Consumer Rights in conjunction with Article 7aa).

§ 29. Out-of-Court Dispute Resolution

  1. The Consumer has the option of using out-of-court methods for handling complaints and pursuing claims, in particular:
  • referring the matter to the permanent consumer arbitration court at the Voivodeship Inspector of the Trade Inspection in Gdańsk;
  • applying to the Voivodeship Inspector of the Trade Inspection in Gdańsk to initiate mediation proceedings for the amicable resolution of the dispute;
  • obtaining free assistance with the resolution of the dispute from the municipal (county) consumer ombudsman or from a social organization whose statutory tasks include consumer protection (for example, the Federation of Consumers).

  1. The Consumer may also use the ODR (Online Dispute Resolution) platform operated by the European Commission, available at: https://ec.europa.eu/consumers/odr.

  2. The use of out-of-court methods for handling complaints and pursuing claims is voluntary and may take place only with the consent of both parties to the dispute.

§ 30. Personal Data and Surveillance

  1. The controller of Customers' personal data is Eldar Kurseitov. Detailed rules for the processing of personal data, including information about the purposes, legal bases, retention period, and the rights of data subjects, are set out in the Privacy Policy available at secretroomgdansk.pl/polityka-prywatnosci.

  2. The venue operates video surveillance (CCTV) covering all areas of the venue, with the exception of restrooms and sanitary facilities. The purposes of the surveillance include: ensuring the safety of Guests and staff, protecting the property of the venue and Guests, and recording events that may form the basis for claims. Recordings are retained for a period of 30 (thirty) days, after which they are automatically overwritten or deleted. The legal basis for processing surveillance data is Article 6(1)(f) of Regulation (EU) 2016/679 (GDPR) — the legitimate interest of the controller. Detailed information about the surveillance, including the rights of data subjects, is set out in the Privacy Policy.

  3. Photographs and recordings may be made at the venue for the purpose of promoting the venue. Where a photograph or recording includes the image of a specific Customer in a way that allows their identification, publication requires that person's consent, unless the image constitutes merely a detail of a whole such as a gathering, a landscape, or a public event (Article 81(2)(2) of the Act on Copyright and Related Rights).

§ 31. Final Provisions

  1. In matters not governed by these Terms, the provisions of Polish law apply, in particular: the Civil Code, the Act on the Provision of Electronic Services, the Act on Consumer Rights, the Act on the Protection of Personal Data and the GDPR, the Act on Upbringing in Sobriety, the Act on the Protection of Health against the Consequences of Tobacco Use, and the Act on Food and Nutrition Safety.

  2. The Service Provider reserves the right to amend these Terms for important reasons, in particular in the event of a change in the law, the introduction of new services, or a change in the scope of existing services. Customers will be informed of any amendment to these Terms by the publication of the new version of the Terms on the venue's website.

  3. An amendment to these Terms takes effect no earlier than 14 days from the date it is published, with the reservation that the previous wording of the Terms applies to contracts concluded before the amendments take effect.

  4. The provisions of these Terms do not exclude or limit any rights of the Consumer arising from mandatory provisions of law. In the event of a conflict between the provisions of these Terms and mandatory provisions of law, the provisions of law apply in place of the conflicting provisions.

  5. Disputes arising from contracts concluded on the basis of these Terms are resolved by the court having jurisdiction in accordance with the provisions of Polish law. With respect to Consumers, the court's jurisdiction is determined in accordance with the provisions of the Code of Civil Procedure.

  6. These Terms take effect on 05.06.2026..
