TERMS OF SERVICE

Stand-up Comedy Events at Secret Room Gdańsk

Effective date: 07.08.2026

§ 1. General Provisions

  1. These Terms and Conditions set out the detailed rules for attending stand-up comedy events held at Secret Room Gdańsk (collectively, the "Events," and individually, an "Event").
  2. These Terms apply uniformly to all stand-up Events held at the Venue, regardless of the performing comedians, the language of the performance, the format of the evening, or the specific date of the Event.
  3. The Event Organizer is Eldar Kurseitov, operating a sole proprietorship, Tax ID (NIP): 5842794144, Business Registry (REGON): 386285549, registered address: al. Grunwaldzka 69, 80-241 Gdańsk (the "Organizer").
  4. Events take place at Secret Room, ul. Stępkarska 7, 80-859 Gdańsk (the "Venue").
  5. These Terms supplement the general Terms and Conditions of Secret Room Gdańsk available at https://secretroomgdansk.pl/regulamin. Matters not covered by these Terms are governed by the general Terms and Conditions.
  6. In case of any conflict between these Terms and the general Terms and Conditions, these Terms shall prevail with respect to stand-up Events.
  7. Acceptance of these Terms occurs at the moment of ticket purchase for any Event and is a condition of attendance.

§2. Nature of the Events

  1. Events are stand-up comedy performances held on the Venue's stage by invited comedians. Performances may be delivered in various languages (including Polish, English, Ukrainian, Russian) and in various formats (including solo shows, group nights, themed evenings). The language, format, and lineup of each Event are specified in its description on secretroomgdansk.pl.
  2. The date, start time, expected duration, and detailed description of each specific Event (including the lineup of comedians, thematic restrictions, and any intermission) are published in the Event description on secretroomgdansk.pl.
  3. Because Events are stand-up comedy performances intended for adult audiences, the content may include profanity, provocative themes, and material of a sexual, political, religious, controversial, or potentially offensive nature. The Attendee accepts this nature of the Events at the time of ticket purchase and shall have no claim against the Organizer on this ground.
  4. Events are open exclusively to persons of legal age (18+). Any additional restrictions are specified in the description of the particular Event. 
  5. The Organizer reserves the right to make changes to the lineup of performing comedians for reasons beyond its control (including illness, force majeure, random events, and organizational changes). Attendees will be notified of any changes on secretroomgdansk.pl and on the Venue's social media. A change in the lineup does not entitle the Attendee to a ticket refund, unless the change concerns the sole performer or the main headliner listed by name in the Event description, whose absence effectively means the Event is canceled.

§3. Tickets and Reservations

  1. Tickets for Events can be purchased via the online form available at secretroomgdansk.pl, under the description of the specific Event.
  2. Ticket prices, seat availability, and any discounts or special offers are specified in the description of the particular Event and may vary depending on the format of the evening and the performing comedians.
  3. A purchased ticket constitutes a prepaid seat reservation for the Event and entitles its holder to enter the Venue and to take the seat assigned by Venue staff.
  4. Ticket purchase requires providing the Attendee's first name, phone number, email address, number of tickets, and, optionally, comments about any special requirements.
  5. Ticket payments are processed online through an electronic payment system supporting Visa, Mastercard, Maestro, American Express, and BLIK.
  6. The ticket purchase agreement is concluded upon successful payment. The electronic ticket is sent immediately to the email address provided by the Attendee.
  7. The seat reservation associated with a ticket purchase is held under the Attendee's first name as provided in the form. An Attendee purchasing more than one ticket does so on behalf of accompanying persons — all persons attend the Event under a single reservation held under one name.
  8. A ticket is valid for a single admission to the Event for which it was issued. A ticket cannot be used for a different Event.

§4. Entry and Conduct During the Event

  1. Entry to the Venue for the Event is 30 (thirty) minutes before the Event starts, unless the description of the specific Event states otherwise.
  2. At entry, the Attendee provides Venue staff with the first name used at ticket purchase and the number of tickets purchased. Based on this information, staff verify the reservation and assign a seat.
  3. Seating at tables is assigned exclusively by Venue staff, taking into account the layout of the room, the number of tickets sold, and the comfort of all Attendees.

⚠️  The Venue has an intimate setting. When attendance is higher, other Attendees of the same Event may be seated at the table where the Attendee is seated. Ticket purchase does not guarantee exclusive use of an entire table, regardless of the number of tickets purchased.

  1. Attendees who purchased tickets in separate transactions but wish to be seated at the same table are asked to notify the Organizer in advance — by phone at +48 888 773 999, by email at kontakt@secretroomgdansk.pl, or by direct message on social media. The Organizer will make reasonable efforts to accommodate such requests, subject to seat availability.
  2. A late-arriving Attendee is entitled to enter the Venue after the Event has begun. Venue staff will seat the Attendee in a manner that minimizes disruption to the ongoing performance. Late arrival does not entitle the Attendee to a refund or to an extension of the Event's duration.
  3. During the Event, the Attendee is required to behave with courtesy and respect toward the performing comedians and other Attendees, in particular by:
  • not interfering with the performance (including not talking loudly and not shouting toward the stage in a manner that disrupts the show);
  • muting or turning off mobile phones;
  • not recording or photographing the performance without the prior consent of the Organizer and the performing artists (see Section 8).
  1. Venue staff reserves the right to remove from the Event any Attendee whose conduct disrupts the Event or violates public order, with no right to a refund.

§5. Menu, Bar, and Service Charge

  1. During the Event, the Attendee may order food and drinks from the Venue's current menu. The bar and kitchen are open throughout the Event, subject to the general kitchen hours set out in Section 4 of the general Terms and Conditions.
  2. For groups of 3 (three) or more people, the Venue automatically adds a 10% service charge to the bill, as specified in Section 16 of the general Terms and Conditions.
  3. The sale of alcoholic beverages and the operation of the shisha area are governed by Sections 14 and 15 of the general Terms and Conditions, subject to the strict 18+ age restriction.

§6. Ticket Refunds and Event Cancellation

  1. Under Article 38(12) of the Polish Consumer Rights Act of May 30, 2014, the Consumer has no right of withdrawal from a distance contract for a ticket to a recreational event on a specified date.
  2. Purchased tickets are non-refundable and cannot be exchanged for another date or another Event, subject to sections 3 and 4 below.
  3. If an Event is canceled for reasons attributable to the Organizer, the Attendee is entitled to choose between:
  • a full refund of the ticket price within 14 days of being notified of the cancellation, credited to the account used for payment;
  • exchange for a ticket of equal value to another Event held at the Venue, subject to prior arrangement with the Organizer.
  1. If the Organizer reschedules an Event, the Attendee is entitled to:
  • retain the ticket and attend on the new date, or
  • receive a refund of the ticket price on the terms set out in section 3(a) above.
  1. The Organizer does not reimburse any additional costs incurred by the Attendee in connection with the cancellation or rescheduling of the Event (including travel, lodging, or childcare expenses).
  2. Notice of cancellation or rescheduling is sent to the email address provided at ticket purchase and published on secretroomgdansk.pl and on the Venue's social media.
  3. An Attendee's failure to attend the Event for reasons attributable to the Attendee does not entitle them to a refund or exchange for another Event.
  4. A ticket that is lost, stolen, or damaged in a manner preventing verification cannot be reissued or replaced. In exceptional cases, the Attendee may report the loss to kontakt@secretroomgdansk.pl — the Organizer will make reasonable efforts to verify the reservation based on system records (name and email address).

§7. Liability of the Organizer and the Attendee

  1. The Organizer is responsible for organizing the Event in accordance with the description published on secretroomgdansk.pl and with applicable law.
  2. The Organizer is not liable for:
  • the Attendee's reactions to the content of the comedians' performances (including themes, profanity, provocations, and jokes on religious, political, or sexual topics) — the Attendee accepts the nature of the Event at the time of ticket purchase;
  • the consequences of the Attendee's consumption of alcohol or other beverages;
  • property left unattended at the Venue;
  • damage caused by other Attendees or third parties;
  • force majeure events (including power outages, technical failures, natural disasters, decisions by government authorities, epidemics, and armed conflict).
  1. The Attendee is financially responsible for damage caused to the Venue's property, to the property of other Attendees, or to third parties, resulting from the Attendee's fault.
  2. The Attendee is required to comply with the general Terms and Conditions of the Venue (including Section 11 — Rules of Conduct at the Venue, Section 14 — Sale of Alcoholic Beverages, and Section 15 — Shisha Area), as well as these Terms.
  3. In the event of a situation threatening the safety of Attendees (such as the need for evacuation or a health emergency), Attendees are required to follow the instructions of Venue staff and emergency services.

Section 8. Recording, Photography, and Image Rights

  1. The comedians' performances at Events are works protected by copyright. Audio and video recording, photography, and retransmission of the performances without the prior consent of the Organizer and the performing artists are prohibited.
  2. A violation of the prohibition in section 1 above may result in:
  • removal of the Attendee from the Event with no right to a refund;
  • civil and criminal liability of the Attendee to the Organizer and the performing artists under the Polish Copyright and Related Rights Act of February 4, 1994.
  1. The Organizer may audiovisually record Events for archival purposes, promotional use of the Venue, and promotional use of the performing artists. By entering the Event area, the Attendee consents to the recording and publication of their image as a member of the audience, within the meaning of Article 81(2)(2) of the Polish Copyright and Related Rights Act.
  2. An Attendee who does not consent to the recording and publication of their image should notify the Organizer before the Event begins. The Organizer will make reasonable efforts to seat the Attendee outside the frame of any cameras.

§9. Complaints

  1. The Attendee has the right to file a complaint concerning the Event or the ticket.
  2. Complaints may be filed:
  • in person immediately after the Event, with Venue staff;
  • by email to kontakt@secretroomgdansk.pl;
  • by phone at +48 888 773 999;
  • in writing to the Venue's address: Secret Room, ul. Stępkarska 7, 80-859 Gdańsk.
  1. A complaint should include: the Attendee's identifying information (first name, last name, email, phone number), the date and name of the Event, a description of the circumstances, and the requested resolution.
  2. The Organizer will review complaints promptly, no later than 14 days from receipt. The response will be provided by a method agreed with the Attendee.
  3. Complaints regarding the content of performances (including jokes, delivery style, or subject matter) do not entitle the Attendee to a refund or any other claim against the Organizer, in accordance with Section 7(2)(a).

§10. Personal Data

  1. The Controller of Attendees' personal data is Eldar Kurseitov (details in §1(3)).
  2. Attendees' personal data (first name, phone number, email address, payment information) are processed for the following purposes:
  • performance of the ticket purchase agreement and organization of the Event (legal basis: Article 6(1)(b) GDPR);
  • fulfillment of the Organizer's accounting and tax obligations (legal basis: Article 6(1)(c) GDPR);
  • pursuit or defense of legal claims (legal basis: Article 6(1)(f) GDPR).
  1. Detailed rules on personal data processing, including Attendee rights (such as access, correction, deletion, and restriction of processing), are described in the Privacy Policy available at secretroomgdansk.pl/polityka-prywatnosci.
  2. Providing personal data is voluntary but necessary to enter into the ticket purchase agreement and to attend the Event.

§12. Final Provisions

  1. Matters not covered by these Terms are governed by: the general Terms and Conditions of Secret Room Gdańsk and Polish law, in particular the Civil Code, the Act on Provision of Services by Electronic Means, the Consumer Rights Act, and the Copyright and Related Rights Act.
  2. The Organizer reserves the right to amend these Terms for valid reasons, in particular in the event of legal changes. Amendments do not affect ticket purchase agreements already concluded.
  3. These Terms do not exclude or limit any Consumer rights arising from mandatory provisions of law.
  4. Disputes arising from these Terms are resolved by the court having jurisdiction under Polish law. Consumers may also use out-of-court dispute resolution methods listed in Section 29 of the general Terms and Conditions (including the EU ODR platform: https://ec.europa.eu/consumers/odr).
  5. These Terms take effect on 07.08.2026 and remain in force until amended or repealed by the Organizer.
